Outdoor School Shop’s (ODSS) Terms of Use is a legal agreement between you, the customer, and ODSS ("we," "us," or "our") that governs your use of the outdoorschoolshop.com website (the Site) and any related services. By using the ODSS site, you signify that you have read, understood, and agree to be bound by these Terms of Use. We have the right to change the Terms of Use at any time. Your continued use of the Site shall be considered your acceptance to the revised Terms of Use. Please refer to our Privacy Statement to ensure clarity to how we can use your personal information and content. By accessing the website, you warrant and represent to the website owner that you are legally entitled to do so. The website owner makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website.

ODSS shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company’s personal information or material and information transmitted over our system. In particular, neither the website owner nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any pricing information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

Applicable laws: use of this website shall in all respects be governed by the laws of the state of New York in the country of the United States, regardless of the laws that might be applicable under principles of conflicts of law.

Product Availability & Display

All orders placed through the Site are subject to our acceptance. We cannot guarantee that all items listed as "in stock" will ship right away, as inventory levels are from time-to-time subject to change outside of our system parameters. It can happen that an item may be in stock when you place an order but is sold out by the time we attempt to process the order. We will notify you if this happens and cancel the item from your order and/or give you a chance to make a substitution if you opt to.

While it is our intent that all pricing information is accurate, we cannot exclude that pricing errors and system glitches, which cause pricing errors, will occur. With this in mind, we do reserve the right, at our sole discretion, to cancel or not process any order placed on the Site if the price was incorrectly provided because of any such error. In such instances, we will notify you by email and correct the price on the Site and defer to you the customer if you want to proceed with the order placement once the pricing error has been rectified.

We attempt to provide accurate descriptions of the products and services available on our Site via both written descriptions and product photographs and videos, but we do not warrant that the descriptions and photos are accurate, complete, reliable, current, or error-free. Note that color can vary significantly as represented online in creative assets vs. when an item is seen in person.

Sales Tax

Sales tax will be added to orders when applicable. It will be displayed during checkout along with any other pricing information that may pertain to your order. Due to the rapidly changing landscape in terms of online sales tax applicability, you may find that we levy sales tax on a subsequent purchase that your previous purchases were not liable for. Customer Account Creation

While you may purchase products from our Site without creating an account, certain features and benefits will require you to create an account. We rely on you to provide current and accurate information when registering for an account. You are responsible for any actions that take place while using your account. Keep your username and password secure and do not allow anyone else to use your username or password to access the Site. ODSS is not responsible for any loss that results from the unauthorized use of your username or password, with or without your knowledge.

By submitting your email address, you agree that ODSS and our third-party service providers may use your email address to contact you about your account, orders, any social media posting to be considered user content and to send you marketing emails, all in accordance with our Privacy Policy.

If you are 13 years of age or younger, please do not submit your name, address, email address, or any other personal information to us. ODSS is concerned about the privacy of young children, and we do not knowingly collect any personal information from a child under the age of 13. Although we do sell children’s products on the site, all the products sold on the site are for purchase by adult only.

Mobile Display

The Site may be available with mobile use. Not all carriers and devices are supported. Your use of the Site may be subject to the terms and conditions of your agreements with your mobile device manufacturer and your carrier.

Mobile Message Service Terms and Conditions

The ODSS mobile message service (the "Service") is operated by ODSS . Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. We may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., cart reminders) from ODSS via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to cancel at any time. You'll receive a one-time opt-out confirmation text message.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages, including, without limitation, notifying us immediately if you change your mobile number.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

Intellectual Property

All content included on the Site, such as photos, text, graphics, designs, logos, catalogs, icons, presentations, videos, data, instructions, photographs, and software (the "Materials") is the property of ODSS or its licensors. These materials are protected by copyright, trademark and other intellectual property laws.

Your use of any of the trademarks found on this Site without express permission is strictly prohibited.

Your comments, suggestions and information are important to us. Certain features of the Site allow you to post or submit comments, reviews, endorsements, testimonials, pictures, videos and other content ("User Content"). User Content does not include your account registration data; providing User Content is voluntary.

As between ODSS and you, you retain ownership over your User Content. By providing User Content, you grant (and promise that you have the right to grant) to ODSS a perpetual, irrevocable, worldwide, royalty-free, transferable, non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, commercialize and sublicense your User Content, in any media for any legal purpose, without any additional consideration due to you.

All content that you submit may be used at ODSS's sole discretion. We reserve the right to change, condense or delete any User Content that we believe violates these Terms of Use. Please contact ODSS to remove any user content generated by you that you no longer want to be displayed. ODSS is not obligated to display any product reviews not deemed productive for whatever reason.
